A district judge on Monday rejected a motion filed by Las Vegas City Schools seeking to dismiss a lawsuit filed by a former teacher and volleyball coach who alleges the district fired her in retaliation for raising concerns about harassment of female students by male coaches.
Former Robertson High School volleyball coach and physical education teacher Stacy Fulgenzi filed the lawsuit in March of 2022 under New Mexico’s Whistleblower Protection Act. This March, the school district asked the court to dismiss the lawsuit on the grounds that the suit was filed outside the statute of limitations and that the matter of her termination had already been litigated through an independent arbitrator.
That arbitration took place in September 2020 after Fulgenzi appealed an earlier decision by the school board to uphold her firing. The arbitrator ruled the district was within its rights to fire Fulgenzi.
After hearing arguments from both sides Monday morning, Judge Michael Aragon denied the school district’s motion, paving the way for the suit to move forward.
In the lawsuit, Fulgenzi said she approached LVCS officials in April of 2019 after several girls on the district’s tennis team notified her that they were being bullied and harassed by male coaches. Fulgenzi alleges that the district not only ignored her concerns, but then retaliated against her for sounding the alarm.
