Refrigeration services company The Articom Group LLC and others won dismissal of a False Claims Act suit alleging fraud under the Covid-19 pandemic Paycheck Protection Program, but they didn’t show that whistleblower suits violate Article II of the US Constitution.
A whistleblower, Relator LLC, failed to plead fraud with sufficient particularity, said Judge Rita F. Lin in a Monday opinion. And Relator didn’t show that Articom made statements to the US government with the intent to deceive, Lin said, dismissing the suit.
