Judge rules on whistleblower suit against Kaleida, UB - The Business Journals

A judge has allowed a whistleblower lawsuit against UB's medical school and Kaleida Health to proceed, while dismissing some individual claims.

A judge’s decision will allow a whistleblower lawsuit by a former surgeon and medical school director to move ahead against the Jacobs School of Medicine & Biomedical Sciences at the University at Buffalo and Kaleida Health.

But individual claims of harassment and retaliatory behavior against two Kaleida/UB executives, as well as claims tied to labor law and not-for-profit law, were dismissed by Judge Michael Siragusa in Erie County Supreme Court. He issued the ruling April 2 on complaints filed last August by Dr. Aaron Hoffman.

According to the original complaint, Hoffman alleged he was targeted and threatened after witnessing and reporting "egregious quality and patient safety concerns" surrounding an unnamed surgeon, including reports of the surgeon leaving equipment inside patients and drinking alcohol or being outside the region when he was on call.
