East Penn Manufacturing Co. won a bid to block the Labor Department from including temporary employees in a case alleging wage-and-hour violations shortly before trial.
“Groundhog Day has come and gone, but in this Court, it feels as if this case is stuck in a time-warp” because DOL “once again” wants to “broaden the scope” of a Fair Labor Standards Act suit filed nearly five years ago, the US District Court for the Eastern District of Pennsylvania said, referencing the 1993 film featuring a holiday time loop.
