A Kansas jury awarded a health care employee $500,000 in January after the employee filed suit against his former employer for unpaid wages.
John Moffit was awarded $500,000 Jan. 9 after a jury found his former employer, ValueHealth, LLC, liable for unpaid wages after Moffit was fired and did not receive severance, despite having no prior warnings or discipline.
ValueHealth specialized in ambulatory surgical centers. When Moffit began his employment with ValueHealth, he signed a contract with a provision that stated he would be awarded $250,000 in severance if his employment was ended prematurely without cause.
However, following the COVID-19 pandemic, business took a downturn as hospitals began to keep more surgeries in house. It was around this time that Moffit was terminated. ValueHealth claimed he had been fired for cause, while he argued his termination was a financial decision, and that the allegation of cause was the company’s way to avoid paying Moffit more money.
The jury returned a verdict on liability, and found ValueHealth’s CEO, Don Bisbee, was jointly and severally liable with the company due to a willful violation of the Kansas Wage Payment Act.
The trial was held in U.S. District Court for the District of Kansas and was presided over by Judge Kathryn Vratil. Of the $500,000 awarded to Moffit, $250,000 was in unpaid wages and $250,000 was in statutory penalty, and included pre-judgment interest from Oct. 1, 2023, to March 4 of this...
