Justices Skip Whistleblower's Claim to Swiss Banking Recovery - Bloomberg Tax

The US Supreme Court on Monday declined to consider whether a whistleblower can maintain his suit against the IRS for a cut of the agency’s $2.3 billion offshore banking disclosure recovery.

Thomas Shands received $8.5 million and criminal immunity for helping the Justice Department in a Swiss banking investigation, but he claimed his activities also warranted a cut of the government’s $2.3 billion recovery from its Offshore Voluntary Disclosure Initiative. The US Court of Appeals for the D.C. Circuit rejected that claim in August, holding that he failed to prove the Tax Court has jurisdiction over the OVDI.
