Truckers who say Knight-Swift Transportation Holdings Inc. and a subsidiary owe them pay failed to establish that there are enough harmed workers to justify class treatment for their wage-and-hour suit.
The truck drivers argued that reasonable inferences based on evidence they presented are enough to clear the low bar for numerosity. But their approach would require the court to “engage in speculation,” and their estimates and presumptions aren’t “grounded in the record,” the US District Court for the Southern District of New York said in an opinion docketed Tuesday.
