On 1 June 2025, a package of laws concerning various aspects of employing foreign nationals came into force, including the Act on the Conditions of Permissibility of Entrusting Work to Foreigners in the Territory of the Republic of Poland.
This Act contains criminal provisions allowing sanctions for irregularities and abuses in the processes of legalising the work and stay of foreigners in Poland. The sanctions have not only been tightened (the amounts of fines for specific offences have been increased), but a completely new provision has also been introduced, which may significantly restrict the operations of entities professionally engaged in employee outsourcing without being entered into the register of employment agencies.
Together with other provisions introduced in early June tightening the rules on employee outsourcing in Poland – covering new grounds for refusing to legalise foreigners’ work, as well as restrictions on running business activities consisting of job placement and temporary work services for foreigners requiring a work permit or a declaration of entrustment of work – this may result in much greater difficulties for businesses that have so far provided employee outsourcing services, as well as for those using such services.
