LaserShip Gets Some Worker Wage Allegations Sent to Arbitration - Bloomberg Law

LaserShip Inc. may require two workers to arbitrate wage-and-hour claims they filed on behalf of a would-be class because the duo signed valid arbitration agreements years before suing.

The workers—two of four named plaintiffs in the case—argued that New York’s interest in vindicating workers’ rights to pursue class actions should prevent enforcement of the agreements’ class waiver and choice-of-law provisions and block arbitration. But that argument is “unavailing,” the US District Court for the Southern District of New York said, staying the duo’s portion of the case.
