Lawsuit against Texas Pete over false advertising dropped - Chron

A year-long legal battle over the authenticity of Texas Pete hot sauce has officially come to an end. Per a news release from TW Garner Food Company, which owns the Lousisina-style hot sauce brand, Phillip White of California filed a motion on Sept. 28 asking the court to dismiss his lawsuit against the hot sauce for not actually being from Texas. It's not clear why White filed the motion, but the court dismissed the lawsuit in its entirety on Thursday.

"We at TW Garner Food Co. are delighted with this result," Ann Garner Riddle, a member of the Garner family and the company's current president and CEO, said in a statement. "Since the lawsuit was filed, we have remained steadfast in our position that our product labels and trademark are truthful and not misleading in any respect, and that the lawsuit had no merit."

On Sept. 12, 2022, White sued the company for false advertising because Texas Pete is not actually made in the Lone Star State and has no connection to Texas. The sauce is actually made in North Carolina, where TW Garner Food Co. is headquartered. In his lawsuit, White said he would have paid less for the hot sauce had he known. He also argued that the brand's advertising hurts smaller Texas hot sauce companies trying to capitalize on their authenticity and asked the court to force Texas Pete to change its name.
