Lawsuit alleges labor law violations, wage theft - Telluride Daily Planet

On Wednesday, a resident of San Miguel County filed a class action lawsuit in San Miguel County District Court naming Telluride Ski and Golf (TSG) as the defendant in a case involving labor law violations and wage theft.

TSG owns and operates The Peaks Resort and Spa.

The named plaintiff in the case is Ruth Rivas, “individually and on behalf of all similarly situated persons,” in the class action.

Rivas has lived in Telluride since 2021 and worked as a housekeeper at The Peaks from approximately June 2021 to January 2023.

The lawsuit comes from Rivas’ employment at The Peaks, where she typically worked 15 hours a day seven days a week, according to the lawsuit. The court filing claims TSG committed wage theft “knowingly, willfully and with reckless disregard of applicable law” by setting up Rivas and other housekeeping staff to be paid by two different companies, TSG for her housekeeping work in the afternoons and Csaba Albas, an LLC contracting with TSG, in the morning shift.

By paying housekeepers from two different entities for essentially the same work at the same location, the lawsuit alleges that TSG avoided the additional cost of paying overtime for work in excess of 40 hours a week.

“TSG … which operates the Peaks Hotel … attempts to use labor contractors to ensure a steady supply of cheap immigrant labor while avoiding its obligations as an employer,” the lawsuit reads.
