Legal Alert: Changes in Labor Law – Legalization of residence and work of foreigners - Dentons

On June 1, 2025, a package of laws came into effect, including:

  • Amendment to the Act on Foreigners,
  • Act on Conditions of Admissibility of Employing Foreigners in the Territory of the Republic of Poland and
  • Act on the Labor Market and Employment Services.

The aim of the introduced changes is, among other things, to achieve milestones set in the EU's National Recovery and Resilience Plan (KPO), eliminate irregularities and abuses in the processes of legalization of work and residence of foreigners, and streamline procedures.

The most important changes for employers include:

1. Digitalization of proceedings regarding the issuance of work permits and statements of entrusting work

The possibility of submitting applications in paper form and conducting correspondence with the office by mail has been withdrawn. These changes make the entire process of issuing work permits and registering statements on employment from the moment of submitting an application to the issuance and delivery of the decision, fully electronic.

However, the possibility of submitting applications for temporary residence permits in paper form has been maintained, also when the purpose of the foreigner's stay is performance of work.

2. New grounds for refusal of work legalization

The authorities processing applications will verify (e.g., through statistical data) whether employers are seeking so-called 'fictitious' work permits.
