AUGUST 29, 2023, FORT LAUDERDALE, FLORIDA, Heath Ritenour and Insurance Office of America are facing Amended Complaint alleging Defamation and Abuse of Process by alleged former IOA Agent. Plaintiff Louis Spagnuolo is seeking information and potential witnesses to the statements made by Heath Ritenour to third parties concerning his association with IOA as an alleged IOA Agent.
According to the Lawsuit’s allegations, at IOA’s annual holiday meeting in 2019, Heath “stood before hundreds of IOA employees, insurance agents and management” which “was recorded and posted online.” The Lawsuit states that at the commencement of Heath’s presentation, he stated “As most of you are aware we’ve been in a really nasty lawsuit…involving a Commission with a guy who was literally a ONE-TIME referral source. JUST ONE TIME…” Directly contradicting Heath’s public statement, Spagnuolo’s Lawsuit not only claims that he had an “Official IOA Corporate Email Address and Signature,” but that he “procured at least THIRTY-THREE (33) business and individual prospects to IOA” and that he was otherwise an IOA Agent.
In Spagnuolo’s Amended Complaint filed in July 2023, he alleges that after he exercised his rights to sue Heath and IOA for, among other claims, Civil Racketeering, they in turn filed a “fraudulent lawsuit” in Seminole County Circuit Court against Spagnuolo and thereafter “when on to use the publicly filed lawsuit to engage in out of court private...
