Capstone Logistics LLC lost its bid to get some claims trimmed from a wage-and-hour suit because it’s too soon to analyze whether the court has jurisdiction over out-of-state workers’ allegations.
The logistics firm moved to toss claims filed on behalf of a proposed Fair Labor Standards Act collective made up of workers from across the country on personal jurisdiction grounds. But the motion is “premature” because so far there aren’t any out-of-state collective claims before the US District Court for the Western District of North Carolina, the court said Tuesday.
