LYNCHBURG, Va. (WSET) — The company that operates a popular Mexican restaurant in Lynchburg has been ordered to pay nearly $200,000 related to its failure to pay overtime to its employees, according to the U.S. Dept. of Labor.
USDOL investigators found Jalisco Inc., which operates Lynchburg's La Carreta restaurant on Timberlake Road, violated the overtime and recordkeeping requirements of the Fair Labor Standards Act by paying straight-time to employees who worked more than 40 hours in a work week.
The USDOL also found the company failed to maintain accurate records of its employees' work hours.
The company will pay $99,480 in back pay, and an additional $99,480 in liquidated damages, totaling $198,961.
“Restaurant employees are essential workers, and employers must pay them all their rightful wages to enable them to provide for their families and themselves,” said Wage and Hour Division District Director Roberto Melendez in Richmond, Virginia. “Unfortunately, shortchanging employees’ wages is not uncommon in the restaurant industry. Employers can avoid costly violations by knowing and complying with the Fair Labor Standards Act.
