Nontipped employees in Maine may participate in tip pools under certain circumtances, under a bill Gov. Janet Mills (D) signed June 15.
LD 903 will go into effect on the 91st day after the state’s current special legislative session adjourns.
Nontipped employees may participate in tip pools if the employer does not take a tip credit and pays all employees at least the state minimum wage, under the bill. However, employers, managers, and supervisors may not receive tips from the tip pool.
