KOTA KINABALU: A company managing director was charged in the Sessions Court here today with 21 counts of using false documents to make claims involving RM369,000.
The company, Infoteguh Sdn Bhd, owns Eastern College.
Marsam Buhera, 49, was charged under Section 18 of the Malaysian Anti-Corruption Commission Act (MACC) 2009, punishable under Section 24(2) of the same act.
He pleaded not guilty to all charges before judge Abu Bakar Manat.
Marsam was accused of submitting forged documents, namely invoices, list of participant names, participant attendance forms, and participant allowance receipt forms to two individuals to make several claims for three Eastern College programmes with intention to deceive the principals.
The alleged offences took place at the Sabah Economic Planning Unit between Jan and Aug 2018.
Marsam could be jailed up to 20 years and fined no less than five times the amount or up to RM10,000, or whichever is higher, upon conviction.
The court fixed April 29 for re-mention. Marsam was released on a RM20,000 bail with RM10,000 to be deposited with the court with a local surety.
The court also ordered Marsam to report once a month to the MACC office and for his passport to be kept by the court.
The court also reminded Marsam not to disturb the prosecution's witnesses pending disposal of the case.
