Maryland’s damages caps for local government tort claims don’t cover job bias cases brought under the statewide civil rights law, the Maryland Supreme Court found.
Joseph Watts’ disability discrimination and retaliation claims against Prince George’s County shouldn’t have been subject to a $400,000 damages cap under the Local Government Tort Claims Act, the court said in a 6-1 decision Monday.
Watts had won a $1.7 million jury verdict, before the trial court applied the damages cap. A state appellate court found his claims shouldn’t have been covered by the LGTCA caps.
