Medieval Times USA sued a union representing some of its employees Thursday in an unusual move that accuses the Medieval Times Performers United guild of violating the dinner theater’s trademark.
The union, set up this year under the American Guild of Variety Artists, purports to be based at a Medieval Times location in New Jersey, and its name will cause consumer confusion if allowed to persist, according to a complaint filed in New Jersey federal court.
“Because Defendants use Medieval Times in the very name of their new organization, coupled with adopting other features meant to evoke Medieval Times and its services, consumer confusion as to an affiliation, sponsorship, or endorsement between the parties is inevitable if not already occurring,” the complaint said.
The lawsuit comes amid a prolonged surge in labor organizing in the private sector, according to National Labor Relations Board statistics. Several newer unions have incorporated company names in their monikers, including Amazon Labor Union, Starbucks Workers United, and Apple Retail Union.
Medieval Times took issue with union materials including a yellow-and-red sword and shield logo, Facebook cover photo, Instagram page and website that the chapter has been using.
