MEMPHIS, Tenn. - A Memphis gynecologist federally indicted for dozens of crimes is asking a judge to throw out some of the charges against him, records show.
A grand jury indicted Dr. Sanjeev Kumar with 46 total counts. However, he wants to throw out the ones involving allegations that he performed medically unnecessary procedures or made false claims about patients.
In a Monday court filing in the U.S. District Court in West Tennessee, he argues that the government didn't prove its case on those charges. The trial started earlier this month.
The government finished presenting its evidence last Thursday.
In his court filing, Kumar said the court should dismiss those counts because of "the Government's failure to present sufficient proof to support a conviction on those charges."
