Menorah Medical Center RN wage-and-hour $1.8M class action ... - Top Class Actions

Midwest Division MMC, the company that operates Menorah Medical Center, agreed to pay $1.8 million to resolve claims it underpaid nurses.

The settlement benefits current and former hourly registered nurses employed by Midwest Division-MMC LLC, HealthTrust Workforce Solutions LLC, Health Midwest Ventures Group Inc. or Health Midwest Medical Group Inc. and who performed nursing services at Menorah Medical Center between July 3, 2016, and Feb. 28, 2019.

According to nurses in the wage-and-hour class action lawsuit, Menorah Medical Center deducted 30-minute meal periods from their work despite the fact they did not take these breaks and they adjusted clock-in and clock-out times. These practices allegedly caused nurses to work off the clock, resulting in underpayment.

Menorah Medical Center hasn’t admitted any wrongdoing but agreed to a $1.8 million class action settlement to resolve these allegations.

Under the terms of the settlement, class members can receive a cash payment based on the number of workweeks they worked during the class period. Consumers may have received a payment estimate with their mailed settlement notice.

Half of each settlement payment will be considered wages for tax purposes, resulting in a W-2 tax form. The other half of each settlement payment will be considered liquidated damages, interest and penalties, resulting in a 1099 tax form.
