Mine Must Pay Whistleblower Despite His Subequent Incarceration - Bloomberg Law

A mine operator should have continued to pay a fired worker even though the he was incarcerated twice while his termination was under review in a federal administrative tribunal.

Tuesday’s 3-1 decision from the Federal Mine Safety and Health Review Commission affirmed an administrative law judge’s order to temporarily reinstate and pay Alvaro Saldivar, a heavy equipment driver for gravel quarry Grimes Rock Inc. of Filmore, Calif.

Attorneys with the US Department of Labor’s Mine Safety and Health Administration had alleged that Saldivar was fired in January 2021 because he made several safety complaints to supervisors.
