Missouri Workers' Comp Law No Bar to Post-Employment Retaliation - Bloomberg Law

Missouri workers are unable to sue under state workers’ compensation law for employer retaliation that occurs after their employment ends, a state appeals court ruled on a question of first impression.

The law’s plain language requires a current employment relationship, the Missouri Court of Appeals said Tuesday. It rejected electrician John Lisle’s attempts to analogize Missouri Revised Statutes §287.780 to Title VII of the 1964 Civil Rights Act and the Fair Labor Standards Act, both of which have been held to prohibit post-employment retaliation.
