Mobbing in Turkish Employment Law - Lexology

The definition of “Mobbing”

We can describe mobbing, which is present in all areas of working life and can always be encountered regardless of the private or public sector, as psychological violence or psychological harassment. Mobbing can be carried out by co-workers or employers against the targeted employee.

While the Turkish Language Association chose the term "harassment" as the Turkish equivalent of mobbing, and the term "psychological harassment" is used in Article 417 of the Turkish Code of Obligations No. 6098, titled "Protection of the Personality of the Employee”. However, terms such as psychological harassment, psychological violence, emotional attack and intimidation are also commonly used as substitutes for mobbing1 . As per the precedent of the Supreme Court of Appeals, mobbing is accepted as all kinds of maltreatment, violence, threat and humiliation. The most common examples are preventing an employee from giving a good account of themselves, interrupting, scolding or constantly criticizing an employee, acting as if the employee is not there in the work environment (ignoring them), cutting off communication, disregarding their ideas, disseminating baseless rumours, making unpleasant allusions, not giving employees qualified work, constantly changing their places by giving employees meaningless work, assigning heavy labour and physical violence2 .
