More Changes Coming for Employers in Ontario: Bill-88, Working for Workers Act, 2022 - JD Supra

On February 28, 2022, Bill-88 – the Working for Workers Act, 2022, was introduced in the Ontario legislature. If passed, Bill-88 will amend various employment-related legislation in Ontario, including the Employment Standards Act, 2000 (ESA) and the Occupational Health and Safety Act (OHSA), and will create new legislation related to digital platform workers, called the Digital Platform Workers’ Rights Act, 2022 (DPWRA). The government of Ontario is seeking comments from the public on the content of the proposed DPWRA until the end of March 2022. Bill-88 is also subject to revisions as it makes its way through the legislative process. We will continue to monitor for substantive changes and updates.

AMENDMENTS TO THE EMPLOYMENT STANDARDS ACT, 2000

Key proposed amendments to the ESA are as follows:

  • Employee monitoring: The ESA will be amended to impose a requirement on employers that employ 25 or more employees to have a written policy with respect to electronic monitoring of employees. The written policy must contain the following information: (a) whether the employer electronically monitors employees and if so, (i) a description of how and in what circumstances the employer may electronically monitor employees, and (ii) the purposes for which information obtained through electronic monitoring may be used by the employer; (b) the date the policy was prepared and the date any changes were made to the policy; and (c) such other information as may be prescribed in the...
