A former employee of a Myrtle Beach area restaurant is accuses the company of violating the state laws, alleging servers and bartenders were paid less than minimum wage.
Madison Doll filed the lawsuit Tuesday against Walk-On’s Sports Bistreaux, according to the Horry County Public Index. The suit also names owners and former managers of the restaurant as defendants.
A manager at the restaurant declined to comment Wednesday afternoon on the allegations.
Doll, who worked at the restaurant from May 2020 to May 2022, claims he and other employees were paid less than what’s required through the state due to an “unlawful tip credit scheme and an unlawful tip pooling scheme.”
The suit doesn’t specify which location Doll worked at. There are two Walk-On’s bars in Horry County.
Owners and managers took a “tip credit” and made employees complete “non-tip producing duties in excess of that allowed by law,” the complaint states.
Instead of paying employees minimum wage for cleaning and food preparation, they were paid $2.13 per hour, the suit stated.
The defendants also illegally refused to pay employees overtime wages when they worked more than 40 hours in a week, according to the complaint.
The lawsuit mirrors similar allegations against other Horry County restaurants in recent years.
In December, multiple lawsuits were filed against North Myrtle Beach restaurant LuLu’s by former employees who claimed the company illegally paid them them less than minimum wage.
