A former Netflix Inc. employee cannot avoid forced arbitration of her workplace sexual harassment claims because the alleged misconduct and her complaint came before a federal law keeping such claims in court took effect, a federal appeals panel held.
Jessica Combs’ lawsuit alleged sexual harassment that would bypass mandatory arbitration under Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act, a three-judge panel of the US Court of Appeals for the Ninth Circuit said. But the alleged incidences happened prior to the law’s effect date of March 3, 2022, the panel said, thus failing to trigger its coverage.
