New for 2022: More COVID-19 Supplemental Paid Sick Leave for California Employees - JD Supra

On February 9, 2022, California Governor Gavin Newsom signed SB-114 into law to reimplement a version of California’s COVID-19 Supplemental Paid Sick Leave. This 2022 version of California’s COVID-19 Supplemental Paid Sick Leave is similar but not identical to the 2021 leave of the same name.

As we previously detailed here, the 2022 version of California’s COVID-19 Supplemental Paid Sick Leave obligations affects employers with more than 25 employees. The law takes effect on February 19, 2022, and will apply retroactively from January 1, 2022 through September 30, 2022. What are the reasons an employee can take 2022 COVID-19 Supplemental Paid Sick Leave?

An employer shall provide COVID-19 Supplemental Paid Sick Leave to each covered employee if that covered employee is unable to work or telework due to any of the following reasons:

1. Quarantine/Isolation:

a. The covered employee is subject to a quarantine or isolation period related to COVID-19 as defined by an order or guidance of the California Department of Public Health (CDPH), the federal Centers for Disease Control and Prevention (CDC) or a local public health officer who has jurisdiction over the workplace.
