Three pieces of separate but similar legislation have been filed in New Jersey, Assembly Bills 3868, 3870, and 3914, which seek to discriminate against recreational cannabis consumers by allowing employers to prohibit its use by certain employees. A 3868 and A 3914 specifically target paid first responders and law enforcement officers, respectively.
Currently under state law, cannabis is legal under state law. Voters in New Jersey passed Question 1 and saw its enactment in January of 2021, which amended the state constitution in a manner that accommodates for the adult-use possession, production, and sale of marijuana to those age 21 or older. Question 1 extended these rights to all of those in the state, discriminating against none on a basis of their chosen profession.
