New law to require licensing for labor intermediaries in the Netherlands - Dentons

The Dutch Senate recently approved a legislative amendment to the Dutch Allocation of Labor through Intermediaries Act (WAADI), significantly strengthening the regulatory framework for labor intermediaries, such as temporary employment agencies and staffing firms, in the Netherlands.

The amendment, which goes into effect from 1 January 2027, will replace the current registration system with a licensing system, applicable to all entities that structurally supply workers. The amendment is motivated by the desire to address abuses in the temporary employment sector, particularly concerning migrant workers.

Under the current WAADI framework, labor intermediaries are subject to a registration requirement with the Dutch Chamber of Commerce. Hirers must verify that the intermediary they engage is properly registered. Failure to comply with this requirement may result in fines for the intermediary if it is incorrectly registered or not registered in the trade register, and for the hirer if it is found collaborating with a non-registered labor intermediary.

Under the licensing system, registration will no longer be enough. Labor intermediaries must submit an application for admission to the Minister of Social Affairs and Employment. This application will include as a minimum:

  • A Certificate of Good Conduct (VOG) confirming that the company and its directors have not committed any relevant criminal offences
