Federal prosecutors can advance claims that New York-based Independent Health Corp. and others violated the False Claims Act by submitting inaccurate information about the health status of beneficiaries enrolled in Medicare Advantage Plans in order to increase reimbursements.

The government sufficiently alleged that the defendants violated legal obligations to provide complete and truthful data in support of a claim for payment, Judge William M. Skretny of the US District Court for the Western District of New York said in a Tuesday order, largely denying the defendants’ motion to dismiss.
