New York-based Premier Home Health Care Services Inc. no longer has to face a False Claims Act suit alleging the company billed Medicaid for deficient services, a federal district court said Monday.

Whistleblower Matthew Thomas Jr.'s complaint lacked specific facts supporting an inference of fraud, and it lacked plausible allegations that Premier submitted bills to the government that were uniquely within the company’s control, the US District Court for the Southern District of New York said. Judge J. Paul Oetken’s order granted Premier’s motion to dismiss with prejudice.
