NFL Enterprises Seeks Dismissal of Former Employee’s Whistleblower Lawsuit - MyNewsLA.com

A lawsuit by a former NFL employee who says he was denied work because he complained about older workers being victims of age discrimination should be dismissed, in part because his own deposition testimony undermines his claims, the company argues in new court papers.

In his Los Angeles Superior Court lawsuit, Adam Gotsens says he began working for NFL Enterprises Inc. in September 2014, assisting the camera crew in studio for shows such as “NFL Gameday” and “NFL Total Access” as well as outdoors at NFL games. But Gotsens says the company stopped hiring him after the 2019-20 NFL season because he complained about disparate treatment toward older employees.

Gotsens cited as an example a young woman who, in his opinion, had little experience or competency, but was given more shifts than others with more knowledge and proficiency who had worked for NFL Enterprises for many years.

“This is unbelievably disrespectful to the people who have put years of their lives in this place,” Gotsens told a human resources representative, according to the suit brought in August 2023.

But in court papers filed Thursday with Judge Rupert Byrdsong in favor of dismissing Gotsens’ suit, NFL Enterprises attorneys state that an internal investigation into the plaintiff’s claims did not substantiate them and instead determined that the female co-worker was a hard worker who actually worked fewer shifts than Gotsens.
