A long outstanding order for public documents reveals Niles was the subject of a grand jury subpoena and summons to appear at a May 2021 grand jury proceeding regarding a whistleblower complaint. The complaint also led to a federal civil lawsuit, which was settled last month.
The federal whistleblower lawsuit against the village of Niles, brought by former Niles Police Cmdr. Nick Beyer was settled — with the village admitting no fault — after village trustees authorized the payment of $100,000 to Beyer at their Nov. 16 board meeting.
On Tuesday, Dec. 6, the village complied with orders for public documents under the Freedom of Information Act, requested by Journal & Topics Media Group, revealing new information about the case.
At about 1:40 a.m. Feb. 28, 2021, Niles police responded to a report of a man passed out in a car in the drive-thru of a McDonald’s on Dempster Street in Niles. The driver of that car turned out to be a civilian Niles police employee, who was not charged and was given a ride home to Elgin by police that morning.
A 136-page document released to the Journal on Dec. 6 showed the grand jury subpoenaed records from the “keeper of records, Niles Police Dept. personnel division”. Iris Martinez, clerk of the Circuit Court of Cook County, stamped the subpoena as filed with the grand jury on April 30, 2021. That document also ordered those holding the records to appear at a grand jury proceeding, which was scheduled to be conveyed on May 14, 2021.
