Reporting an uncivil boss to human resources doesn’t qualify a worker for whistleblower protections, a New Jersey appeals court ruled Tuesday.
A triad of New Jersey health care workers’ employment cases were rejected because the screaming, name calling, and verbal beratement they received wasn’t sufficient to cross the line from workplace gripe to actionable unlawful conduct, the New Jersey Superior Court Appellate Division ruled.
The supervisor’s “outburst, although inappropriate and unprofessional, was a work-related statement by a supervisor to a supervisee. No reasonable jury could conclude otherwise,” the court said in its unauthored opinion.
