Noncompetes and employment law: Physicians can enlist a new employer to fight an old noncompete

Physicians may find that a new employer also can be a new ally against with a previous employer. Christopher S. Mayer, J.D., an employment law specialist with the firm , discusses why this is important when doctors consider their future work.
Medical Economics: The possibility, the prospect of getting a new employer to lend that aid, that sounds like that could be a helpful tool for physicians.
Christopher S. Mayer, J.D.: It is. And the worst thing you can do when you're leaving and you're bound by a noncompete is to lie to your former employer, deceive your former employer about what you're planning to do. Oh, no, no, I'm not going to work, and then go somewhere else. That's when you get into trouble. And the same thing with your new employer. If they ask you the question, obviously you have to disclose that you have a noncompete. Don't hide it, let your new employer know, I got this restriction, I'm worried about it, what do you want me to do? First, let their legal team opine on it, look at it, offer their opinion. I still think it's important to potentially have, depending on the circumstances, have your own separate counsel in that situation, as we talked about. But let their legal team look at it. Don't hide it from your new employer, though. You don't want to do that.
