Tuesday, November 8, 2022: Illinois and Tennessee Voters Went in Opposite Directions on Labor Law Ballot Measures

Illinois likely to become the first state to constitutionally bar right-to-work laws

As a result of Tuesday’s midterm elections, Illinois appeared poised to become the first state to amend – by means of a ballot initiative – its constitution to provide a broad right to organize and collectively bargain and bar “right-to-work” laws. Meanwhile, Tennessee voters decisively approved a measure to enshrine the state’s “right-to-work” law into the state constitution. “Right-to-work” laws bar union security agreements between employers and employee unions which require employees who are not union members to pay union dues or “fair share” fees.
