Some Ohio construction employers must comply with new E-Verify rules under HB 246 starting Friday, requiring verification of employees' legal working status.
OHIO, USA — Ohio construction employers will face new hiring verification rules in March when the E-Verify Workforce Integrity Act (HB 246) takes effect.
The law requires contractors, subcontractors and labor brokers on nonresidential construction projects to use the federal E-Verify system to confirm that all new employees are legally authorized to work in the United States.
Prior to HB 24, Ohio employers were required to complete the federal I-9 Form for new hires, but the state did not mandate the use of E-Verify except where already required by federal law or specific contracts. The new law expands the verification requirement statewide for many construction employers, covering projects such as commercial buildings, infrastructure improvements, bridges, utilities and other public or private nonresidential construction. Residential construction, agricultural structures and single-family homes are not included under the law.
The law largely confirms that every employee is legally authorized to work. This includes U.S. citizens, permanent residents, green card holders and noncitizens with a valid work visa or an Employment Authorization Document (EAD) issued by the federal government.
