OSHA orders trucking firm to reinstate driver in safety whistleblower case - businessinsurance.com

The U.S. Labor Department ordered a Texas trucking company to reinstate a driver and pay more than $100,000 in damages after finding the worker was unlawfully fired for raising vehicle safety concerns.

After an investigation, regulators concluded that Fort Worth, Texas-based Balkan Express violated the Surface Transportation Assistance Act, which protects commercial drivers from retaliation for reporting safety-related issues.

The Occupational Safety and Health Administration ordered the employer to reinstate the driver and provide back pay with interest, along with compensatory and punitive damages. The total award exceeded $100,000, the Labor Department said Thursday. The investigation found that the driver engaged in protected activity by raising concerns related to transportation safety and was fired as a result of doing so.
