NHS Employers has responded to a government consultation on proposed reforms to the Working Time Regulations and holiday pay.

The Department for Business and Trade has recently consulted on reforms to the Working Time Regulations, holiday pay, and the transfer of undertakings (protection of employment) regulations (TUPE).
The department identified areas that it believes could benefit from reform, to ensure that the regulations are fit for purpose for both businesses and workers.
To help inform our response to this consultation, NHS Employers undertook a survey to gather the views of employers in the NHS. Overall employers supported the government’s proposals, with some of the key points from our response including:
- employers did not agree to proposed changes to remove the legal requirement to keep a record of daily working hours for employees. This is to ensure employers have appropriate measures in place to ensure the health and safety of their staff is maintained and employers are currently able to easily record and manage this using existing employee software
- employers agreed that creating a single statutory leave entitlement would make it easier to calculate holiday pay and reduce the administrative burden. Employers felt the single rate of holiday pay should be paid at normal rate, however this would have cost implications for anyone on the minimum NHS holiday entitlement of 27 days
