Outagamie judge Mark McGinnis to hear arguments Monday on employment status for Wisconsin health care workers - Post-Crescent

APPLETON - Lawyers for ThedaCare and Ascension Wisconsin will appear in court in Appleton for a formal hearing on their dispute over a group of employees who sought to leave jobs at ThedaCare and work for Ascension.

Outagamie County Circuit Court Judge Mark McGinnis will hear the case at 10 a.m.

Last Thursday, ThedaCare lawyers asked the court to temporarily stop seven of its employees from taking new jobs at Ascension's St. Elizabeth Hospital in Appleton. The employees are part of an 11-member interventional radiology and cardiovascular team.

Lawyers for ThedaCare argued that Ascension's taking of the majority of their team at the same time would pose a public health threat to the region, and that patients may now have to be diverted hours away for high-level stroke and trauma care.

Ascension lawyers said the employees applied for and received better offers from their hospital, gave ThedaCare a chance to match it weeks before the employees were set to leave, and ThedaCare chose not to do so.

In a hearing Friday, McGinnis told the lawyers to work something out by the end of the day or the temporary restraining order he signed barring the employees from starting at Ascension would go into effect until he could make a further ruling.
