What are the biggest challenges you currently see in employment law?

Broadly, one of the biggest challenges is trying to bring the law in alignment with the everyday challenges most workers experience. For example, as AI seeps into almost all workplaces, will it benefit workers or make them obsolete? Now that cannabis is legal in Minnesota, what are the circumstances under which it is appropriate to fire a worker for failing a drug test? And as municipalities adopt higher minimum wage requirements, how will that affect companies that operate in more than one municipality in the same state? Getting the best results for our clients in a rapidly shifting legal landscape keeps us focused on the present but anticipating the future.

What are the biggest misconceptions about the field of employment law?

There is a misplaced belief that any time a worker is terminated unfairly, the termination is illegal. Not so. Most of us will have a really bad boss at some time in our careers, but terminations are only illegal if the motivation for the termination is discriminatory or retaliatory. The law can’t bring justice or give a fired worker back their dignity, but holding employers to account when they do discriminate or retaliate can make them change their behavior going forward. That’s what we work toward — not just getting good results for our current clients but making the workplace better for all workers.
