Parent alleges daughter was strip-searched at Brevard County school multiple times - WESH

BREVARD COUNTY, Fla. —

A lawsuit has been filed against the Brevard County School Board as well as school and district leadership. The lawsuit alleges a student was strip-searched multiple times, and it makes other serious allegations.

Claims made in the lawsuit include that L.B. Johnson Middle School ignored ongoing complaints about "misogynistic and racial slurs" that a student, identified as a 14-year-old girl, had to endure daily.

The lawsuit alleges that the family, the Daytons, were retaliated against by the district, alleging that the student's adoptive father was falsely accused of molesting the student.

It also says the student was illegally strip-searched three times at Eau Gallie High School.

The lawsuit, filed Nov. 14, claims that the Daytons filed a complaint with the Department of Education related to "the ongoing lack of action to protect students of color." It says the school board then started to retaliate against the family, including through what the lawsuit calls false allegations of molestation. The suit alleges that in September of 2024, school officials "at Eau Gallie High School called DCF and stated" the student was "pregnant and molested" by Dayton, her adoptive father.

The lawsuit claims the student told investigators she was never molested, and the father provided a pediatrician's report to investigators proving the girl had never been pregnant.
