Two Pennsylvania nursing facilities operated by Spring Creek SNF LLC and Franklin Center OPCO LLC have been ordered to pay $256,684 in back wages and an equal amount in liquidated damages to 231 nursing staff, the Labor Department said Thursday.
A Wage and Hour Division investigation found that the employers engaged in pay practices that violated the Fair Labor Standards Act by paying non-discretionary bonuses to nursing staff without including the incentives in their pay rate when calculating overtime rates, according to the DOL.
