A former Penske Truck Leasing Co. worker failed to secure collective status for his wage-and-hour suit after a federal judge in Arkansas found his allegations of a common policy of overtime reduction lacking.
The ex-employee accuses the truck rental company of making workers falsify time records to artificially reduce overtime. But the worker “provides little evidence to suggest there was a common plan or policy of this type,” the US District Court for the Eastern District of Arkansas said, denying the motion for conditional certification of a Fair Labor Standards Act collective.
