Workers must litigate their wage claims against a physical and occupational therapy provider in federal court after the Ninth Circuit overturned a district judge’s order sending the case back to state court.
The district judge determined VibrantCare Rehabilitation Inc., which removed the state complaint to federal court in California on diversity grounds, hadn’t shown that the case met the amount in controversy requirement. But the lower court improperly discounted the value of the workers’ claims, the US Court of Appeals for the Ninth Circuit said in an unpublished opinion.
