A whistleblower convinced the full US Court of Appeals for the Fifth Circuit to review a decision that gave Planned Parenthood Federation of America Inc. immunity from a suit alleging Medicaid fraud.
The Fifth Circuit granted the whistleblower’s petition for rehearing en banc in a Thursday order.
A three-judge panel’s Feb. 26 ruling is vacated, the order said. The clerk will specify a briefing schedule for the rehearing, it said.
