Police Officer Claims Nashville PD Denied Employment Over HIV ... - Law.com

A Tennessee police officer claims the Metropolitan Nashville Police Department rescinded an employment officer after learning of his positive HIV status, according to a federal complaint filed Friday.

This suit was first surfaced by Law.com Radar.

The anonymous plaintiff, identified as John Doe in court documents, alleges the department denied him a previously offered positive as a police office because he lives with HIV. Doe argues that MNPD’s policies are unlawful and constitute a violation of federal law including, but not limited to, the Americans with Disabilities Act and the Civil Rights Act.

The complaint states that Doe’s health care provider assured the department that his condition is “fully suppressed and un-transmittable” to his co-workers or community at large.

The employment discrimination lawsuit was filed in the U.S. District Court for the Middle District of Tennessee against the Metropolitan Government of Nashville and Davidson County on behalf of Doe, a 45-year-old Black man and civil servant who has worked as a Tennessee State Trooper and with the Memphis Police Department for several years. He has received awards for his service, including Memphis PD Officer of the Year and Officer of the Year at his previous precinct, the complaint said.
