Possible settlement between Texas AG Ken Paxton, whistleblowers in air - Austin American-Statesman

The uncertainty over a $3.3 million settlement between Texas Attorney General Ken Paxton and four whistleblowers who reported him to the FBI grew Wednesday after their attorneys said Paxton will not agree to an end-of-the-Legislative session deadline.

Attorneys for the four plaintiffs notified the state Supreme Court in a nine-page filing about the latest obstacle to the proposed settlement. They said that having the tentative settlement approved and funded by lawmakers this year is a key condition of the agreement, but Paxton insists that if the Legislature does not sign off on it this session, the deal could be pushed to 2025 — or longer.

That dispute has led both sides to an impasse in reaching a final agreement, the filing said.

The attorney general’s office "says it is still researching what happens if the Legislature decides not to fund during this session,” attorneys for the whistleblowers wrote.

The suit has sat for 16 months before the Supreme Court, which is weighing a request by Paxton to rule on a lower court’s finding about whether the suit could proceed. Attorneys for the whistleblowers notified the court last month that they could delay making a ruling because both sides had reached a tentative settlement.
