A compliance consultant turned whistleblower can continue to allege that Bronx-based home healthcare provider FEGS Home Attendant Services Inc. and others violated the False Claims Act by improperly receiving Paycheck Protection Program funds, a federal district court said.

FEGS failed to show that the FCA’s public disclosure bar precluded Yvonne Ward’s claims, Judge Pamela K. Chen of the US District Court for the Eastern District of New York said in a Tuesday order denying a motion to dismiss.

Her claims aren’t substantially the same as information in tax returns and US Small Business Administration data, the court said. ...
